As a condition of the Bayview 360 LLC Rental Agreement, the Renter certifies that he/she is experienced and qualified to properly handle the boat or will have a Designated Operator among the group. The Renter and any Designated Operator must be approved by the Company by completing a Qualified Boat Operator Attestation Form. No other person is permitted to operate the vessel. A Designated Operator must meet the following criteria to be considered a competent person eligible for insurance coverage under the Company’s Bareboat Charter Endorsement:
1) a minimum of 2 years of experience operating vessels of a similar type and size to the scheduled vessel;
2) no marine losses in the last 10 years;
3) no violations or suspensions (including auto) in the last five years; and
4) no criminal convictions or pleas of no contest ever.
The Renter understands that all liabilities for injury, death or damage to property remain with the Renter, regardless of who may be operating the vessel at the time.
While neither CT nor NY State law require a boating license for day rental operation of a powerboat, Bayview 360 LLC strongly encourages prospective renters to obtain their boating license and requires it as part of standard vetting procedures. Exceptions may be granted in limited circumstances where practical experience and extenuating circumstances warrant.
Renters are only permitted to navigate within the areas defined by the Company as the Navigation Zone. The Navigation Zone consists of the protected waters of Long Island Sound, the Peconic Bays, and the waters surrounding Shelter Island. The Long Island Sound allowable navigation zone is bounded on its eastern side by a line from Niantic, CT to Plum Island, NY to Gardiners Island, NY. The Renter is not permitted to operate the boat east of this allowed area without the prior written consent of the Company.
The following equipment is included: minimum USCG-required safety equipment for corresponding recreation vessel including: 1) one Type I, II, or III PFD for each person on board (max. 10); 2) one Type IV throwable device; 3) one horn or alternative sound-producing device; 4) visual distress signals including day-time and night-time use handheld flares and signal flag; 5) fire extinguisher. While not a requirement, a VHF radio is provided. Additionally, an adequate number of dock lines, fenders, anchor and auxiliary anchor.
Fuel expenses are not included in the rental rate. Fuel cost will be paid by the Renter and charged based on usage at the prevailing price offered by local fuel docks. Fuel consumption can vary significantly and is a function of engine usage time, fuel burn rate and the price of fuel. Our 24’ Calypso averages a fuel burn rate of approx. 13 gph (gallons per hour) and our 28’ Sirena averages a fuel burn rate of 18 gph, with higher consumption for aggressive acceleration or above average RPM cruising speeds.
As stated in the rental agreement, “Should the boat be returned damaged, the Renter is responsible for all costs related to repairs or replacement of the vessel, including those costs that may exceed the amount held initially as security deposit. The Renter should check the terms of their personal liability coverage as part of their homeowner’s insurance policy or related coverage to assess their overall coverage needs.”
Yes, with sufficient advance notice, we are often able to accommodate alternative start and/or drop-off locations, including private docks or municipal and commercial marinas. Multi-day rentals may also keep the boat at an approved offsite mooring or dock, subject to prior approval.
